<br />Environmental Review <br /> <br />This extension of the moratorium on medical marijuana dispensaries is exempt for review <br />under the California Environmental Quality Act (CEQA) as it is not a project under CEQA; and <br />if a project under CEQA, will not result in a direct or reasonably foreseeable indirect physical <br />change in the environment and only directs that a planning study be undertaken. (14 CCR <br />sections 15060(c)(2), 15061(b)(3), 15262) <br /> <br />FISCAL IMPACT <br /> <br />It is not expected that extending the moratorium on medical marijuana dispensaries would have <br />a significant effect on City revenues or expenses. <br /> <br />STAFF RECOMMENDATION <br /> <br />City staff recommends that the City Council: <br /> <br />I) Extend the existing moratorium on medical marijuana dispensaries for 10 months <br />and 15 days as allowed by law to protect a current and immediate threat to the <br />public health, safety and welfare as set forth in this staff report and attachments, as <br />well as the staff report and attachments presented to the City Council on August 16, <br />2005; and <br /> <br />2) Direct staff to send the attached letter to federal representatives. <br /> <br />Respectfully Submitted, <br /> <br />Michael H.
