Northeast Creek <br /> <br />30. The developer shall submit a revegetation plan for the area around the northeast creek for <br /> review with the tentative map. The purpose of this plan shall be to reestablish native <br /> plant vegetation along the slopes leading to the edge of the creekbank in order to enhance <br /> this riparian habitat and to prevent any future erosion of the channel due to surface runoff. <br /> This revegetation plan shall be developed with the assistance of a biologist and shall <br /> include a plan for the future maintenance of this vegetation as well as the drainage <br /> channel. <br /> <br />31. The developer shall have his consulting engineers and biologist reexamine the extent of <br /> erosion of the creekbed area and evaluate possible remediation to stabilize the banks and <br /> prevent further erosion. This evaluation and possible methods for stabilizing the <br /> creekbed shall be submitted for review with the tentative map. The developer shall be <br /> responsible for completing the remediation and other creek improvements approved with <br /> the tentative map. <br /> <br />32. The northeast creek and adjacent open space area shall be owned and maintained by the <br /> project's homeowners association. The developer shall prepare a schedule of the required <br /> annual maintenance of all the project's open space areas which includes the requirements <br /> of the biologist for the creekbed area and those of the City's wildfire management plan for <br /> this area. This maintenance schedule shall be incorporated into the project's CC&Rs. <br /> The homeowners association shall be responsible for the completion of this scheduled <br /> maintenance as well as any other maintenance or repairs to the creekbed deemed <br /> necessary by the City Engineer. The City shall be granted a right-of-entry and <br /> maintenance easement to this area for the purposes of completing emergency repairs if <br /> required. The revised site plan shall show the location and design of an access driveway <br /> extending from the Independence Drive EVA to this creekbed area for use by <br /> maintenance vehicles. The surface of the driveway shall be designed to blend into the <br /> natural open space environment through the use of open pavers or other such means <br /> which provides an all-weather surface. Final design of the material and location shall be <br /> shown on the tentative map submitted for the review and approval by the Planning <br /> Commission. A maintenance schedule shall also be submitted to the City Engineer and <br /> Planning Director prior to the approval of the final map. A section of the fence along the <br /> EVA shall be made to function as a locked gate to allow emergency vehicles to use the <br /> gavel drive. <br /> <br />33. The developer shall record an open offer of dedication for a public trail easement to the <br /> City for the creekbed area and 8.2-acres common open space area on the final map. The <br /> design and location of any future trail would be required to be reviewed by the City's Park <br /> and Recreation Commission at a public hearing. <br /> <br /> <br />
