Additionally, the developer shall be responsible for coordinating with the owners of these <br /> existing residences concerning the location of the new utility laterals to within 3 ft. of the <br /> structures per the requirements of the NSSP. The developer shall be responsible for <br /> obtaining permission for the construction of said laterals on these private properties and <br /> shall bear the entire cost of their installation. Copies of these owners' authorization shall <br /> be submitted prior to the approval of the tentative map. <br /> <br />15. The developer shall construct single-story homes on Lots 4 and 5 immediately next to the <br /> Carlson residence. A deed restriction shall be recorded prohibiting any future <br /> second-story addition on these homes. <br /> <br />16. The maintenance of all private hammerhead drives, except the one connecting to the <br /> Independence Drive EVA, shall be the responsibility of all of the property owners of the <br /> homes which use the respective drive as an access to their lots. An agreement outlining <br /> the maintenance responsibilities, apportionment of costs, etc. shall be submitted for the <br /> review and approval of the Planning Director and City Attorney prior to the approval of <br /> the final map. No parking shall be permitted on the private hammerhead streets. <br /> <br />17. The private hammerhead drive connected to the Independence Drive EVA shall be <br /> increased in width by 4 ft. This private drive shall have two 10 ft. travel lanes, 5 ft. wide <br /> planter strips behind the curb, and 5 ft. wide sidewalks. A 3 ft. portion of the sidewalk on <br /> both sides of the drive shall be located in the 8 ft. wide P.S.E. over which a public access <br /> easement shall be granted. The roadway, planter strips, and sidewalks shall be <br /> maintained by the homeowners association. <br /> <br />18. A private drainage easement shall be recorded along the western side property line of <br /> Lot 26 for an approved stormwater release from Lot 15. The detail of this stormwater <br /> channel/and or pipe shall be submitted for the review and approval of the City Engineer <br /> and Planning Director prior to the approval of the final map. Also, the homeowners <br /> association shall be responsible for the maintenance and yearly inspection to ensure that it <br /> is unobstructed and in a state of good repair. The City shall be granted the right to enter <br /> the easement, but not the obligation, to enforce the maintenance responsibilities of the <br /> property owners association and make emergency repairs. <br /> <br />19. No building permit shall be issued or lot sold for any of the new homes within this project <br /> until after the new elementary school located on Case Avenue is operational. The <br /> applicant may request modification of this condition based on the progress being made on <br /> the construction of the new elementary school being planned on Case Avenue or other <br /> new elementary school, with the intent being that no home shall be occupied until the <br /> school is opened. <br /> <br /> <br />
