12. The east side of Lot #3 shall be treated as the front yard with a 20 <br /> foot setback and the west side of Lot #3 shall be treated as the rear <br /> yard with a 20 foot setback. A revised development plan showing <br /> the changed setbacks shall be submitted to the Planning Director for <br /> review and approval in conjunction with the parcel map application. <br /> During the design review process for the home on this lot, the <br /> Planning Director may approve minor variations in the required <br /> setbacks. <br /> <br />6. Prior to recordation of any parcel map, a separate deed instrument for the <br /> easements on the Bach property shall be completed and submitted to the City <br /> Attorney for review and approval. The easements on the Bach property shall be <br /> recorded prior to the recordation of the parcel map. <br /> <br />7. Prior to final parcel map approval and recordation a disclosure notice shall be <br /> submitted to the City Attorney and Planning Director for review and approval <br /> informing all future property owners of the future trail connection to San Carlos <br /> Way. <br /> <br />8. The construction of the pedestrian path on the Bach property shall be the <br /> responsibility of the developer of the Bach property. The exact location and <br /> timing for the installation of the path shall be determined in conjunction with the <br /> Bach PUD application. <br /> <br />9. The sidewalk on the east side of the shared driveway on Lots #2 and #3 shall be <br /> installed in conjunction with the subdivision improvements for this development. <br /> The improvement plans submitted in conjunction with the parcel map shall detail <br /> these improvements and shall be subject to review and approval of the City <br /> Engineer. <br /> <br />10. Prior to recordation of the final parcel map, all required fees applicable to this <br /> property contained in the Noah Sycamore Specific Plan Finance Plan shall be <br /> paid. Lot #2 shall not be required to pay the NSSP Finance Plan fees unless it is <br /> rebuilt or demolished pursuant to the Finance Plan. Any such fees shall be paid <br /> prior to issuance of a building permit for a remodel/addition or a new home. <br /> <br />11. In conjunction with any parcel map application, the relocation of the private <br /> driveway around trees # 152 and # 159 shall be explored in an effort to preserve this <br /> tree. <br /> <br />PUD-99-02 City Council - Conditions of Approval Page 4 <br /> <br /> <br />
