That the proposed conditional use will comply with each of the applicable provisions <br /> of the zoning ordinances. <br /> <br /> Chapter 18.124 of the Municipal Code (Conditional Use) states that, because of their <br /> unusual characteristics, conditional uses require special consideration so that they may be <br /> located properly with respect to their effects on surrounding properties. The proposed <br /> expansion plan, with reasonable conditions of approval, can integrate the proposed <br /> expanded Church use without detrimentally affecting the surrounding properties or the <br /> City in general. This third finding can be made. <br /> <br /> PUBLIC COMMENTS <br /> <br /> The project was continued from the July 19, 2005 and notices for thc appeal were sent to all <br /> property owners within 1,000 feet of the subject property and thc entire Valley Trails <br /> neighborhood. <br /> <br /> ENVIRONMENTAL ASSESSMENT <br /> <br /> This project is categorically exempt from environmental review pursuant to California <br /> Environmental Quality Act Guidelines, Section 15301, Existing Facilities, Class 1, <br /> subsection 9(e)(2) (A) and (B). <br /> <br /> FISCAL IMPACT <br /> <br /> The proposed ordinance would have a negligible financial impact on the City. <br /> <br /> CONCLUSION <br /> <br /> As a result of thc success of thc facilitation process, a new design was created meeting thc <br /> concerns of the neighborhood and including the design features the Church had wanted. Duc to <br /> this success, amended conditions of approval are attached for the City Council's review <br /> reflecting the points of agreement for thc revised plan. Staff believes that the revised master site <br /> plan and Phase I design review plans will result in an attractive Church facility which will fit in <br /> with and be an asset to the neighborhood. <br /> <br /> Staff~ therefore, supports the revised plan. This option will entitle St. Clare's Episcopal Church <br /> to develop the site according to the master site plan as shown on thc revised Exhibit A. This <br /> action will approve the site plan, location, and sizes of the structures shown, the Phase I design <br /> review approval for thc construction of the Multipurpose Room consisting of 4,325 square feet, <br /> thc Worship Expansion consisting of a 620 square foot addition, and the phasing of the project. <br /> SR:05:244 <br /> Page 9 <br /> <br /> <br />
