l>Lg A$&NTON city Council Staff Report August 16, 2005 Public Works Department Law Department SUBJECT: QUITCLAIM OF CITY'S INTEREST IN OPEN OFFER OF LAND AND EASEMENT DEDICATION FOR ACCESS AND PUBLIC UTILITY PURPOSES, TRACT 7193~ SYCAMORE HEIGHTS STAFF RECOMMENDATION: Staff recommends that the City Council approve the quitclaims for the subject easements and authorize the City Manager to: 1. Quitclaim the City's interest in and to an open offer of dedication for a 0.24 acre parcel of land for public utilities, and ingress and egress over a portion of lot 8 of Tract 7193, Sycamore Heights and; 2. Quitclaim the City's interest in and to an open offer of dedication for a 25-foot wide access and public utility easement over lot 38 of Tract 7193, Sycamore Heights. SUMMARY: Tract 7193, Sycamore Heights, is currently being developed by Summerhill Homes and is located at the eastern terminus of Sycamore Creek Way and Sunset Creek Lane, adjacent to Tract 6982, Bridle Creek. An open offer of dedication was made to the City for a small parcel of land for future access and utilities, which serves the Sycamore and Lund water reservoirs. Summerhill has relocated the access driveway including utilities serving the reservoirs. This offer of dedication is no longer required. Additionally, a second open offer of dedication for a 25-foot wide easement was offered to the City per Parcel Map 5376 for future access and utilities. With the development of Sycamore Heights, this offer of dedication is no longer required. In both cases, the open offers of dedication were originally rejected by the City and County, but remained "open-offers" for future acceptance, if needed. With the development of the street extensions by Summerhill, both offers will no longer be needed. The next step is for the City to quitclaim its interests to these offers of dedication.
