l>Lg A$&NTON city Council <br /> Staff Report <br /> <br /> August 16, 2005 <br /> Public Works Department <br /> Law Department <br /> <br />SUBJECT: QUITCLAIM OF CITY'S INTEREST IN OPEN OFFER OF LAND <br /> AND EASEMENT DEDICATION FOR ACCESS AND PUBLIC <br /> UTILITY PURPOSES, TRACT 7193~ SYCAMORE HEIGHTS <br /> <br />STAFF RECOMMENDATION: <br /> <br /> Staff recommends that the City Council approve the quitclaims for the <br /> subject easements and authorize the City Manager to: <br /> <br /> 1. Quitclaim the City's interest in and to an open offer of dedication for a <br /> 0.24 acre parcel of land for public utilities, and ingress and egress over a <br /> portion of lot 8 of Tract 7193, Sycamore Heights and; <br /> <br /> 2. Quitclaim the City's interest in and to an open offer of dedication for a <br /> 25-foot wide access and public utility easement over lot 38 of Tract <br /> 7193, Sycamore Heights. <br /> <br />SUMMARY: Tract 7193, Sycamore Heights, is currently being developed by Summerhill <br /> Homes and is located at the eastern terminus of Sycamore Creek Way and <br /> Sunset Creek Lane, adjacent to Tract 6982, Bridle Creek. An open offer of <br /> dedication was made to the City for a small parcel of land for future access <br /> and utilities, which serves the Sycamore and Lund water reservoirs. <br /> Summerhill has relocated the access driveway including utilities serving the <br /> reservoirs. This offer of dedication is no longer required. Additionally, a <br /> second open offer of dedication for a 25-foot wide easement was offered to <br /> the City per Parcel Map 5376 for future access and utilities. With the <br /> development of Sycamore Heights, this offer of dedication is no longer <br /> required. In both cases, the open offers of dedication were originally <br /> rejected by the City and County, but remained "open-offers" for future <br /> acceptance, if needed. With the development of the street extensions by <br /> Summerhill, both offers will no longer be needed.
