subdivision was approved last year, staff determined that it would be appropriate to abandon this
existing sanitary sewer easement after the new sanitary sewer line was installed and operational.
The new sanitary sewer was installed with the new streets of the development, and therefore no
new easements were required for this line. The new sanitary sewer has now been in operation for
several months and the old sanitary sewer has been removed. Consequently, Ponderosa Homes is
now asking that the City formally abandon the sanitary sewer easement.

Staff recommends vacating the existing sanitary sewer easement located within the Ponderosa
Homes development (Tracts 7381, 7428 and 7430). The easement is further described within the
attached grant deed document.

FISCAL IMPACT

There would be no fiscal impact on the City from vacating this easement. This easement was
obtained by the City at no cost; therefore, staff recommends that there be no compensation to the
City by Ponderosa for the abandonment of the easement.

Respectfully Submitted,

Rob Wilson Michael H.
