THE CITY OF 4E

pL£ AS&NTON cit Council
Staff Report

August 16, 2005
Public Works Department
Law Depmh,ent

SUBJECT: ABANDONMENT OF A SANITARY SEWER EASEMENT WITItIN
TRACTS 7381, 7429 and 7430, PONDEROSA HOMES

STAFF RECOMMENDATION

Staff recommends that the City Council take the following action at the
meeting of August 16, 2005:

1. Adopt the attached resolution abandoning the sanitary sewer easement
within Tracts 7381, 7428 and 7430.

SUMMARY: The City has a sanitary sewer easement running from the City's Operation
Service Center westerly to the easterly end of Kamp Drive. The City
acquired this easement from Mr. Busch, the adjacent property owner, in
1989 when the OSC was constructed. Ponderosa Homes has since installed a
new sanitary sewer main within their development to replace the original
sewer main. Consequently, Ponderosa Homes is now asking the City to
abandon the existing sanitary sewer easement.

Honorable Mayor and Members of the City Council:

BACKGROUND

When the City constructed the Operations Service Center (OSC) in the early 1990's, the closest
sanitary sewer was located on the easterly end of Kamp Drive. In order to provide sanitary sewer
service to the OSC, it was necessary for the City to acquire a sanitary sewer easement from Mr.
Busch, the adjacent property owner. This easement ran from the OSC, across Mr. Busch's
pumpkin patch, and tied to the easterly end of Kamp Drive. Since that time, Ponderosa Homes
has acquired this portion of the Busch property and is building homes on the site.
