that the contract on the property could be cancelled subject to certain <br /> conditions, including the payment of a cancellation fee ($562,500). Centex <br /> has paid this fee to the City and Council action includes canceling the <br /> contract. <br /> <br />Honorable Mayor and Members of the City Council: <br /> <br />BACKGROUND <br /> <br />Tract 7385 is a single-family residential subdivision proposed by Centex Homes. The site is <br />located between the Old Vineyard Avenue roadway (which is to be converted to a <br />hiking/equestrian trail) and the realigned Vineyard Avenue, east of the future Neal School site. <br /> <br />In addition to 28 single-family residential lots, Tract 7385 also creates two vineyard estate lots <br />and 2.22 acres of open space. A three-acre parcel (formerly the Simoni parcel), currently in <br />the County adjacent to this development, will be merged via a lot line adjustment with Lot 30 <br />(one of the vineyard estate lots). This merger will take place after the three-acre parcel is <br />annexed to the City. This annexation will be initiated at a subsequent City Council meeting. <br />An agricultural easement covering the non-building envelope of the vineyard estate lots will be <br />granted by separate instrument to the City and the Tri-Valley Land Conservancy will be a a <br />third party beneficiary under that easement. The owners of the vineyard estates will be <br />responsible for the planting and maintenance of the vineyards. <br /> <br />Engineering staff, Planning staff, and the City Attorney's Office have reviewed the Final Map, <br />Improvement Plans, and other legal documents for Tract 7385. The developer has prepared <br />the required disclosure deeds and CC&R's. All submittals are in substantial conformance with <br />conditions of the approved tentative map. Development fees have been paid, including fees <br />pertaining to the Vineyard Avenue Corridor Specific Plan, to the Tri-Valley Land <br />Conservancy, to cancel the Williamson Act on the property (discussed in more detail below), <br />and for a pro-rata share of the cost of construction of the Ruby Hill Fire Station. <br /> <br /> Proposed Improvements <br /> <br /> The streets within this development, Safreno Way, Mingoia Street, and Machado Place, are <br /> public and will be maintained by the City. The storm drain, sanitary sewer and water systems <br /> within these streets serving this project will be maintained and operated by the City. The open <br /> space, street trees, entry monuments, and landscaping along the project frontage of the <br /> proposed Vineyard Trail will be maintained by a homeowners' association. <br /> <br /> SR:05:218 <br /> Page 2 of 4 <br /> <br /> <br />
