commenced and is diligently pursued toward completion or an extension has <br /> been approved by the City. <br /> <br /> 7. Any changes to the proposed phasing of the project shall be submitted for the <br /> review and approval of the Planning Director. Said request shall demonstrate <br /> that sufficient parking would be available on-site for the facility and approved <br /> uses on the site. <br /> <br /> 8. The project developer shall revise the proposed master expansion plan to show <br /> that no portion of the building will encroach into the required setback area. A <br /> revised site plan shall be submitted for the review and approval of the Planning <br /> Director prior to issuance of a building permit. <br /> <br /> 9. The project developer shall submit a recordable agreement between St. Clare's <br /> Episcopal Church and Masonic Lodge for the construction and use of the <br /> extended parking lot during Phase II expansion review. This agreement shall <br /> be reviewed and approval of the City Attorney's Office prior to issuance of <br /> building permits for Phase II. <br /> <br /> 10. This approval does not include the expansion of the existing preschool <br /> program. In the event that existing preschool program is proposed to be <br /> expanded, a separate conditional use permit shall be required. At that time, a <br /> traffic study and noise analysis shall be submitted as part of the use permit <br /> application. In any event, the applicant shall replace the fence around the <br /> playground area with a solid fence and shall provide landscaping on the <br /> National Park Road side of the new fence prior to issuance of building permits <br /> for Phase I. The fence and landscape plans shall be submitted for the review <br /> and approval of the Planning Director and shall be installed as part of Phase I <br /> construction. <br /> <br /> 11. Prior to the issuance of a building permit for Phase I, the project developer <br /> shall provide window details for review and approval by the Planning Director. <br /> The details shall show a two-inch window recess from the building wall. <br /> <br /> 12. Prior to the issuance of a building permit for Phase I, the project developer <br /> shall propose mitigations to reduce the noise level at the playground so that the <br /> noise level does not exceed 60 dBA of the property line as allowed by the <br /> Noise Ordinance. The said mitigations may include, but are not limited to, the <br /> construction of a solid fence and rescheduling outdoor playtime. Additionally, <br /> the project developer shall add landscaping to soften the appearance of the <br /> fence.
