The study on existing economic conditions will include demographic and labor trends, key sectors
for future job growth, and retail leakage and potential. This study will necessitate the use of
confidential financial data, including business license tax and sales tax data. Staff is requesting
authorization to release this data to the consultant. In addition, to meet State Board of Equalization
confidentiality standards, the Council must adopt a resolution specifically authorizing the release of
sales tax data to BAE. Lastly, while the existing contract with BAE contains a confidentiality
clause, staff is asking Council for authorization to amend that section to add additional language to
conform to requirements in the resolution.

FISCAL IMPACT

There is no fiscal impact resulting from the recommended actions. However, the study resulting
from the requested release of data to the consultant is expected to result in an Economic
Development Plan that will help the City sustain or improve its economic and fiscal vitality.

Respectfully submitted,

Susan Rossi Nelson Fialho
Director of Finance City Manager

Attachment: Resolution

SR 05:211 Page 2
