However, until INS leaves the site, the INS use can operate on a short-term basis with limited adverse impacts on the adjacent neighbors, provided that the conditions of approval are adopted and enforced. B. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. The proposed INS' facility is inappropriate as a long term use of the site, however the proposed hours of operation, and the conditions recommended by staff, will limit the impacts to the surrounding uses. Any areas of possible concern have been conditioned so that the proposed use will meet all applicable Municipal Code requirements in the short term. The applicants can also be required to mitigate any future nuisances or problems. Therefore, if all the conditions of approval are complied with, the proposed use will not detrimentally impact the surrounding properties in the short term. c. The proposed conditional use will comply with each of the applicable provisions of the zoning ordinance. Chapter 18.124 of the Municipal Code (Conditional Uses) states that, because of their unusual characteristics, conditional uses require special consideration so that they may be located properly with respect to their effects on surrounding properties. Reasonable conditions of approval can temporarily allow the proposed use without detrimentally affecting the surrounding properties or the City in general. The proposed use will also comply with all provisions and requirements of the City's zoning ordinance. WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the Planning Commission determined that the proposed conditions of approval will provide adequate protection of the neighbors' health, safety, and general welfare until the Interstate Nuclear Services relocates. . ..
