However, until INS leaves the site, the <br />INS use can operate on a short-term basis with <br />limited adverse impacts on the adjacent neighbors, <br />provided that the conditions of approval are <br />adopted and enforced. <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The proposed INS' facility is inappropriate as a <br />long term use of the site, however the proposed <br />hours of operation, and the conditions recommended <br />by staff, will limit the impacts to the surrounding <br />uses. Any areas of possible concern have been <br />conditioned so that the proposed use will meet all <br />applicable Municipal Code requirements in the short <br />term. The applicants can also be required to <br />mitigate any future nuisances or problems. <br />Therefore, if all the conditions of approval are <br />complied with, the proposed use will not <br />detrimentally impact the surrounding properties in <br />the short term. <br /> <br />c. The proposed conditional use will comply with each <br />of the applicable provisions of the zoning <br />ordinance. <br /> <br />Chapter 18.124 of the Municipal Code (Conditional <br />Uses) states that, because of their unusual <br />characteristics, conditional uses require special <br />consideration so that they may be located properly <br />with respect to their effects on surrounding <br />properties. Reasonable conditions of approval can <br />temporarily allow the proposed use without <br />detrimentally affecting the surrounding properties <br />or the City in general. The proposed use will also <br />comply with all provisions and requirements of the <br />City's zoning ordinance. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed <br />conditions of approval will provide adequate protection <br />of the neighbors' health, safety, and general welfare <br />until the Interstate Nuclear Services relocates. <br /> <br />. .. <br />
