PLANNING COMMISSION CITY OP PLEASANTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-94-40

RESOLUTION APPROVING A CONDITIONAL USB PERMIT AS FILBD UNDER
CASE UP-94-35, THE APPLICATION OF CURRIN CONSTRUCTION COMPANY

WHEREAS, Currin Construction Company has applied for a conditional
use permit to remodel and enlarge two existing
residential units and to establish a horse boarding and
training facility in existing stables as interim uses in
the previOUSly-approved Oak Tree Farm PUD located at 8015
Foothill Road; and

WHEREAS, zoning for the property is PUD (Planned Unit Development)
- Rural Density Residential and Low Density Residential
District.

WHEREAS, at their duly noticed pUblic hearing of August 10, 1994,
the Planning commission considered all public testimony,
relevant exhibits and recommendations of the City staff
concerning this application; and

WHEREAS, the Planning Commission made the following findings:

A. That the proposed locations of the conditional uses
are in accordance with the objectives of the zoning
ordinance and the purpose of the district in which
the site is located.

Residences: Although the residences are located
within the geotechnical "no build zone" established
during the tentative map stage, the continued
existence of these structures, and their
enlargement, does not increase the likelihood of
hazard, nor does it pose any greater risk to
property or occupants. The homes are located on a
portion of the property designated for residential
uses. The expansion of the structures does not
increase their non-conformity in regard to
setbacks, yard areas, parking, floor area ratio,
etc. The existing residential uses are in
accordance with the intent of the residential
zoning of the property.

Boarding Facility: The boarding facility is
contained wholly within the southern portion of the
property in an area which historically has been
used for horse-related activities. Although the
use is non-conforming, the city's Municipal Code
permits expansion or continuation of non-conforming
uses in PUD-designated zones through the use permit

II

"
