<br />PLANNING COMMISSION CITY OP PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-94-40 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USB PERMIT AS FILBD UNDER <br />CASE UP-94-35, THE APPLICATION OF CURRIN CONSTRUCTION COMPANY <br /> <br />WHEREAS, Currin Construction Company has applied for a conditional <br />use permit to remodel and enlarge two existing <br />residential units and to establish a horse boarding and <br />training facility in existing stables as interim uses in <br />the previOUSly-approved Oak Tree Farm PUD located at 8015 <br />Foothill Road; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Rural Density Residential and Low Density Residential <br />District. <br /> <br />WHEREAS, at their duly noticed pUblic hearing of August 10, 1994, <br />the Planning commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. That the proposed locations of the conditional uses <br />are in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Residences: Although the residences are located <br />within the geotechnical "no build zone" established <br />during the tentative map stage, the continued <br />existence of these structures, and their <br />enlargement, does not increase the likelihood of <br />hazard, nor does it pose any greater risk to <br />property or occupants. The homes are located on a <br />portion of the property designated for residential <br />uses. The expansion of the structures does not <br />increase their non-conformity in regard to <br />setbacks, yard areas, parking, floor area ratio, <br />etc. The existing residential uses are in <br />accordance with the intent of the residential <br />zoning of the property. <br /> <br />Boarding Facility: The boarding facility is <br />contained wholly within the southern portion of the <br />property in an area which historically has been <br />used for horse-related activities. Although the <br />use is non-conforming, the city's Municipal Code <br />permits expansion or continuation of non-conforming <br />uses in PUD-designated zones through the use permit <br /> <br />II <br /> <br />" <br />
