<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-94-32 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FrLED UNDER <br />CASE UP-94-21, THE APPLICATION OF WESTBROOK HOUSING GROUP <br /> <br />WHEREAS, Westbrook Housing Group has applied for a conditional use <br />permit to allow the placement of excess dirt material <br />from the Kottinger Ranch construction site to three sites <br />located on the Lin property and one site located in the <br />open space area of the Kottinger Ranch development <br />located at the terminus of Hearst Drive and approximately <br />600 feet southerly of the terminus of Red Feather Court; <br />and <br /> <br />WHEREAS, zoning for the property is PUD (Planned unit Development) <br />- RDR/OS (Rural Density Residential/Open Space) District; <br />and <br /> <br />WHEREAS, at their duly noticed public hearing of June 8, 1994, the <br />Planning commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, at its meeting of June 8, 1994, the Planning Commission <br />approved a negative declaration for Case UP-94-21; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />1. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The objectives of the zoning ordinance and the PUD <br />(Planned Unit Development) - RDR/OS (Rural Density <br />Residential/Open Space) District are to: foster a <br />harmonious, convenient, and workable relationship <br />among land uses, protect existing land uses from <br />inharmonious influences and harmful intrusions, and <br />insure that public and private lands ultimately are <br />used for the purposes which are most appropriate <br />and beneficial to the city as a whole. <br /> <br />The proposed fill sites are located in the <br />least sensitive areas of the Kottinger Ranch <br />development and the Lin property with respect <br />to existing native oak trees. natural terrain, <br />and streambeds. <br /> <br />II <br /> <br />II <br />
