The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The proposed dance instruction to be carried out by <br />the applicant would include background music played <br />at a low volume to facilitate voice instruction, <br />thus neighboring uses should not be affected by the <br />dance classes. If the conditional use is per- <br />mitted, the suite would be properly retrofitted to <br />accommodate the needs of the students and teachers. <br /> <br />Given the availability of parking at the Mission <br />Plaza shopping center property, the Plaza <br />professional building property, and on Santa Rita <br />Road, the dance studio should not adversely affect <br />the availability of parking spaces in the shopping <br />center complex. <br /> <br />3. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />The conditional use is required to comply with all <br />applicable sections of the Municipal Code governing <br />properties zoned Central Commercial. By complying <br />with the recommended conditions of approval, the <br />application would meet the criteria for receiving a <br />conditional use permit and would, therefore, comply <br />with the intent of the zoning ordinance. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA)i and <br /> <br />WHEREAS, the Planning Commission determined that the proposed <br />conditional use, as conditioned, is appropriate for the <br />site and will be compatible with the surrounding uses. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case UP-94-25, the application of Henry and <br />Laura Cabrera (Pleasanton Academy of Dance) for a <br />conditional use permit to establish a classical ballet, <br />jazz, and tap dance and children's tumbling studio <br />Offering private and group instruction located at 1987 <br />Santa Rita Road, suites "C" & "D" (Mission Plaza Shopping <br />center), subject to the conditions shown on Exhibit "B" <br />attached hereto and made part of this case by reference. <br /> <br />. ., <br />
