The proposed development shall conform substantially to the <br />site plan, building elevations, and related materials, <br />Exhibit A (dated "Received March 14, 1994"), on file with <br />the Planning Department, except as modified by these <br />conditions. <br /> <br />2. All conditions of Case PUD-91-19 shall remain in full force <br />and effect. <br /> <br />3. The developer shall submit a revised landscape plan for the <br />front and side yard areas which reflects the revised Fire <br />Department turnaround location. This revised landscape plan <br />shall be submitted for the review and approval of the <br />Planning Director prior to the issuance of a building <br />permit. This landscape plan shall be substantially similar <br />in design intent with the landscape plan approved with PUD- <br />91-19. The proposed trees on the northern side of the <br />structure shall be a 36" box size. <br /> <br />4. The developer shall submit a plan illustrating the design of <br />the deck to be used along the rear elevation of the <br />structure to the Planning Director for review and approval <br />prior to the issuance of a building permit. The deck shall <br />be designed so as to minimize any exposed support structures <br />for the deck through the use of lathe screening, stepping <br />the deck, and/or using a cantilevered support system. No <br />flat yard areas shall be graded at the rear of the structure <br />for recreational purposes. <br /> <br />5. The developer shall provide an updated tree report for the <br />review and approval by the Planning Director prior to the <br />issuance of a building permit. This report shall evaluate <br />the impact of the revised house location and shall identify <br />appropriate mitigations, if any. If it is determined that <br />this revised house location would be detrimental to the <br />health of the adjacent existing trees, the Planning Director <br />may determine that the design of the structure should be <br />modified to eliminate any adverse effect on the health of <br />the trees. <br /> <br />6. The developer must apply for and receive a building permit <br />for this lot within three years of the date of this approval <br />and must begin construction of the private roadway serving <br />this lot and post the required bonds for its completion, to <br />the satisfaction of the city, prior to September 1, 1995. <br />In the event that either of these two deadlines are not met, <br />the development plan shall expire and the applicant shall be <br />required to submit the same or new development plan for city <br />approval. <br /> <br />II ., <br />
