The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />Given the existing hours of operation, the proposal <br />will not impact other surrounding uses. The <br />applicant does not plan to alter the exterior of <br />the building. Other similar services in the area <br />have been conditionally approved by the Commission <br />and have not caused any reported problems. The <br />existing warehouse will comply with applicable <br />Building and Fire codes. D.R.K. Specialties will <br />not involve the use or storage of any hazardous <br />materials. Based on the aforementioned, the <br />project will not be detrimental to the public <br />health, safety, or welfare and that this finding <br />can be made. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />As conditioned, the <br />all provisions and <br />zoning ordinance. <br /> <br />existing use will comply with <br />requirements of the City's <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the existing use, <br />as conditioned, will be compatible with the surrounding <br />uses and properties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case UP-95-57, the application of Donald Kuhn, <br />for a conditional use permit to establish a wholesale and <br />distribution business in an existing industrial building <br />located at 5671 Sonoma Drive, subject to the conditions <br />shown on Exhibit "B" attached hereto and made part of <br />this case by reference. <br /> <br />section 2. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br />
