<br />Resolution No. PC-94-16 <br />Page 2 <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />Given the proposed activities and hours of <br />operation for the subject use, it will not impact <br />surrounding uses. Any areas of possible concern <br />have been conditioned so that the proposed use will <br />meet all applicable Municipal Code requirements. <br />The applicants can also be required to mitigate any <br />future nuisances or problems. Therefore, if all <br />the conditions of approval are complied with, the <br />proposed auto storage lot will not detrimentally <br />impact the surrounding properties. <br /> <br />C. <br /> <br />The proposed conditional use will <br />of the applicable provisions <br />ordinance. <br /> <br />comply with each <br />of the zoning <br /> <br />Chapter 18.124 of the Municipal Code (Conditional <br />Uses) states that, because of their unusual <br />characteristics, conditional uses require special <br />consideration so that they may be located properly <br />with respect to their effects on surrounding <br />properties. Reasonable conditions of approval can <br />integrate the proposed use without detrimentally <br />affecting the surrounding properties or the city in <br />general. The proposed use will also comply with <br />all provisions and requirements of the City's <br />zoning ordinance. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning commission determined that the proposed <br />conditional use, as conditioned, is appropriate for the <br />site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case UP-94-05, the application of American <br />Bankers Acceptance Corporation for a conditional use <br />permit to allow outdoor warehousing of repossessed <br />automobiles on an approximately 1.5 acre lot located at <br />3878 Stanley Boulevard, subject to the conditions shown <br />on Exhibit "B" attached hereto and made part of this case <br />by reference. <br /> <br />II <br /> <br />II <br /> <br />- <br />
