Property owners to the south shall be granted access rights <br />over the frontage road should they wish to eliminate their <br />current access to Foothill Road and connect to the frontage <br />road. This condition shall be reflected on the Parcel Map. <br /> <br />8. Property owners to the west who currently have access rights <br />over the private road shall be granted additional access <br />rights should they wish to develop in the future. The <br />applicant shall be eligible for reimbursement of the access <br />road construction costs. Those new property owners shall be <br />required to join into the homeowners association to pay their <br />pro-rate share of road and landscape maintenance expenses. <br /> <br />9. Development shall follow the conclusions and recommendations <br />contained in the Geotechnical Engineering Investigation for <br />Lamb Land Surveying, dated November 20, 1989, prepared by <br />TerraSearch Inc. <br /> <br />10. The property is hereby rezoned to the PUD-LDR zoning <br />designation. <br /> <br />11. Prior to Parcel Map approval, a bond for the private <br />improvements including but not limited to streets, water, <br />sewer, and storm drains shall be submitted to the satisfaction <br />of the City Engineer. These improvements shall be constructed <br />wi thin one year of the recording of the Parcel Map unless <br />otherwise approved by the Planning Director or City Engineer. <br /> <br />12. The alignment, width and grade of the private street shall be <br />subject to the approval of the City Engineer and Fire <br />Marshall. The final street configuration shall be worked out <br />prior to submittal of the parcel map. <br /> <br />13. The applicant shall extend underground public utilities <br />(sanitary sewer, water, gas, electrical, telephones, cable <br />T. V. l in the private street from Foothill Road in such a <br />manner that when the frontage road to Jorgensen Lane is <br />created, those existing utilities stubbed into the development <br />from Foothill Road can be abandoned. The developer shall <br />grant the City a public service easement over said streets. <br />The location of these shall be shown on the tentative map. <br /> <br />14. The applicant shall pay a pro-rata share of the sanitary sewer <br />in Foothill Road per a prior agreement with the City prior to <br />submitting final map for approval. <br /> <br />15. Access to the existing properties served off the driveway on <br />Foothill Road shall be maintained at all times during <br />construction. <br /> <br />16. The typical section of the east/west private street shall be <br />designed to be ultimately 20 feet in right-of-way width. <br />Parking will not be permitted and the street shall be posted <br />for "NO PARKING." In conjunction with this application, the <br />developer shall design and construct the ultimate 18 foot wide <br />roadway paving, including 9' 6" of the road on his property and <br />that area within the access easement, generally 8'6", on the <br />
