An open offer of dedication for a public access easement shall <br />be recorded with final map over that portion of Parcel "0" not <br />located in previoUSly approved Final Maps (Tracts 5721 and <br />5875l. Final wording shall be to the satisfaction of the <br />Planning Director and the City Attorney. In the event the <br />City shall exercise its option to accept the public access <br />easement, the city shall enter into a agreement holding the <br />owner of that portion of Parcel "D" free from liability due to <br />the public use of the area. <br /> <br />6. If pUblic access is to be provided to Tract 6023, then a <br />public access staging area shall be constructed by the <br />applicant in the general area located near the terminus of "H" <br />Court. The staging area shall be maintained by the project's <br />homeowners association. Final design details of the staging <br />area shall be worked out by the applicant to the satisfaction <br />of the Planning Director prior to issuance of the first <br />building permit for Tract 6023. The staging area shall be <br />completed prior to acceptance of Tract 6023 by the city. This <br />requirement may be waived by the Planning Director. Final <br />determination as to whether "H" Court shall be a private <br />street, with public access, or a public street shall be made <br />by the Planning Director prior to recording the final map. <br /> <br />11 <br />
