PC-91-110 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-91-84 FOR FRANK BALGEMAN <br /> <br />WHEREAS, Frank Balgeman has applied for a conditional use permit <br />to operate a one-person acoustical recording business <br />within the existing single-family residence located at <br />1891 Palmer Drive; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Developmentl <br />- Medium Density Residential District; and <br /> <br />WHEREAS, at their duly noticed public hearing of December 11, <br />1991, the Planning commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />city staff concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Chapters 18.32 and 18.36 permit home occupations to <br />be conducted in residences in R-1 and RM zones, in <br />accordance with Chapter 18.104 (Home Occupationsl. <br />Some of the objectives of the R-1 and RM districts <br />are to protect properties from hazards, noise and <br />congestion created by commercial and industrial <br />traffic, and to protect properties from noise, <br />illumination, unsightliness, odors, dirt and other <br />objectionable influences and hazards. <br /> <br />The objective of Chapter 18.104 is to permit <br />certain occupations which will not adversely affect <br />the residential character of the neighborhood, yet <br />to permit certain activities which normally occur <br />in residences, such as music composition and <br />practice. The required conditions for non-exempt <br />home occupations meet the objectives of the R-1 and <br />RM zones by not permitting manufacturing or <br />deliveries to the home, or the creation of <br />pedestrian or vehicular traffic in excess of that <br />usually generated by residential uses. <br />
