<br />condition of approval to mitigate interior noise to <br />minimize impacts on adjacent tenants within the <br />complex. <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The proposed health club facility is not <br />anticipated to have an adverse impact on any of the <br />surrounding properties due to the small scale of <br />the proposed expansion and the proposed conditions <br />of approval which would serve as performance <br />standards. Adequate parking is available to <br />prevent encroachment onto neighboring properties, <br />and conditions have been included to prevent <br />adverse impacts from car headlight glare and noise. <br />A proposed condition would permit the revocation of <br />the use permit if any violation of federal or state <br />laws (e.g. the illegal use or sale of steroids) is <br />found on the premises. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />The proposed conditional use complies with all the <br />applicable provisions of the Zoning Ordinance, <br />Chapter 18 of the Municipal Code, regarding <br />parking, loading, and noise levels. <br /> <br />WHEREAS, applications to modify an approved use permit are <br />considered exempt (Class 5) from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the proposed expansion to the Gold's Gym and the addition <br />of the aerobics classes would not significantly alter the <br />operation of the business and would not have any adverse <br />impacts on surrounding uses within the Arbor complex, <br />other uses in the business park, or the residential <br />properties located across the Arroyo Mocho. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case UP-91-69, the application of J&R Gym <br />Group/Gold's Gym for a conditional use permit to modify <br />an approved conditional use permit to allow the addition <br />of approximately 3,252 sq. ft. to the existing 13,693 sq. <br />ft. lease space for Gold's Gym located at 5860 West Las <br />positas BlVd., suite 7 (Hacienda Business Park), subject <br />to the conditions shown on Exhibit "A" attached hereto <br />and made part of this case by reference. <br />
