The proposed development shall conform sUbstantially to the <br />site plans, elevations, and related materials, Exhibit A <br />(dated "Received October 31, 1991"), on file with the Planning <br />Department, except as modified by these conditions. <br /> <br />2. The developer shall obtain all building and other applicable <br />city permits for the project prior to the commencement of <br />construction. <br /> <br />3. The applicant shall submit a landscape plan for the Santa Rita <br />Road frontage of Rose Pavilion -Phase III that shows the <br />location and species of sixteen 24" box trees to be planted as <br />a replacement for the sixteen trees which were to have been <br />relocated. This location plan and the proposed species shall <br />be submitted for the review and approval by the Planning <br />Director prior to the issuance of a building permit. <br /> <br />4. <br /> <br />The proposed signs for the <br />comprehensive sign program <br />Pavilion - Phase III, on file <br /> <br />project shall adhere to the <br />previously-adopted for Rose <br />with the Planning Department. <br /> <br />5. The development plan for Rose Pavilion - Phase III shall <br />include a pad for a 6,650 square foot restaurant in the area <br />shown as the location of the Sizzler restaurant. The <br />architectural and landscape architectural design for the <br />sizzler restaurant is excluded from this design review <br />approval and any subsequent design for a restaurant in this <br />location must be submitted for the review and approval by the <br />Design Review Board prior to the issuance of building permits <br />for the restaurant. <br /> <br />6. The applicant shall reduce the glare from the parking lot <br />lights by adding shields directing the light away from the <br />adjacent residence at 3596 Chippendale Court. The shields <br />shall be installed prior to issuance of building permits for <br />any of the three proposed buildings, to the satisfaction of <br />the Planning Director and the adjacent neighbor. <br /> <br />In addition, the applicant shall negotiate in good faith with <br />the management of Garcia's Restaurant and Outdoor World, and <br />shall require on the pad restaurant and southern elevation of <br />the Goodyear building, that the tenant signage be turned off <br />at the close of business each day. <br />
