Chapter 7.28 - Licensing and Impounding Fees

The proposed ordinance simplifies this chapter in light of the suggested revisions to the
definition chapter (7.04) as discussed above. The proposed ordinance deletes §7.28.030 because
this provision is addressed in Chapter 7.12. The proposed ordinance revises (and re-numbers)
the current §7.28.040 to use the term "service dog" in lieu of "seeing eye dog" to reflect that
service dogs provide assistance in ways other than helping a person who is visually impaired.

Chapter 7.32 - Rabies

The proposed ordinance simplifies this chapter in light of the suggested revisions to the
definition chapter (7.04) as discussed above.

Chapter 7.36 - Miscellaneous Animal Regulations

The proposed ordinance simplifies this chapter in light of the suggested revisions to the
definition chapter (7.04) as discussed above. The proposed ordinance deletes §7.36.050. This
revision would allow pet stores to sell baby chicks, rabbits, ducklings or other fowl as pets. Pet
stores often do not sell baby chicks, rabbits or ducklings at Easter, or puppies or kittens before
Christmas, in order to ensure that the animals will be cared for on a long term basis, rather than
for a short tenn.

Chapter 13.08 - Parks and Recreation Facilities

The proposed ordinance amends §13.08.080 to specifically address dogs in the various public
parks in Pleasanton, including the Softball Complex, Val Vista soccer fields, dog exercise
facilities and Augustin Bemal Park. Section §13.08.080(B) in the proposed ordinance includes
the Parks and Recreation Commission's recommendation that dogs (leashed or unleashed) be
prohibited from the fenced soccer fields at Val Vista Community Park. Dogs on a leash and
accompanied by an owner would still be allowed in other areas of the park, including the small,
unfenced, informal field that is used for soccer practice and casual recreation. The proposed
ordinance also prohibits dangerous dogs, as defined, in Augustin Bemal Park and other public
parks.

When the Parks and Recreation Commission reviewed the proposed ordinance, it recommended
that the term "trails" be explicitly referenced in the Code in order to expressly address dogs at
large on trails because a number of trail users have been observed with their dogs (on and off
leash). Sections 13.08.020 and 13.08.080(A) of the proposed ordinance make explicit that dogs
may not be at large on trails tmless an exemption applies.

SR:05:163
