<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALJ:FORNIA <br /> <br />RESOLUTION NO. PC-91-64 <br /> <br />RESOLUTION APPROVING A HOME OCCUPATION USE PERMIT AS FILED <br />UNDER CASE UP-91-49 FOR TRICIA EGAN <br /> <br />WHEREAS, Tricia Egan has applied for a home occupation use permit <br />to conduct piano lessons within the residence located at <br />3604 Manchester street; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Medium Density Residential District; and <br /> <br />WHEREAS, at their duly noticed pUblic hearing of September 11, <br />1991, the Planning commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Chapters 18.32 and 18.36 permit home occupations to <br />be conducted in residences in the R-1 and RM zones, <br />in accordance with Chapter 18.104 (Home <br />Occupations). Some of the objectives of the R-1 <br />and RM districts are to protect residential <br />properties from the hazards, noise and congestion <br />created by commercial and industrial traffic, and <br />to protect properties from noise, illumination, <br />unsightliness, odors, dust, dirt and other <br />objectionable influences and hazards. <br /> <br />The objective of Chapter 18.104 is to permit <br />certain home occupations which will not adversely <br />affect the residential character of the <br />neighborhood, yet to permit the conduct of certain <br />activities which normally occur in residences, such <br />as piano lessons. The required conditions for non- <br />exempt home occupations meet the objectives of the <br />R-1 and RM zones by not permitting manufacturing or <br />deliveries to the home, or the creation of <br />pedestrian or vehicular traffic in excess of that <br />usually generated by residential uses. <br /> <br />The location of the house in which the piano <br />lessons are to be conducted is in a PUD-MDR zone, <br />which is a residential zone similar to the R-1 <br />
