<br />PLANNING COMMISSION CITY OF PLEASAHTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-91-S1 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-91-32 FOR KENTUCKY FRIED CHICKEN <br /> <br />WHEREAS, Kentucky Fried Chicken has applied for a conditional use <br />permit to construct a drive-through window and lane for <br />an existing fast-food restaurant located at 1803 Santa <br />Rita Road; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned unit Development) <br />- Commercial District; and <br /> <br />WHEREAS, at their duly noticed public hearing of July 24, 1991, <br />the Planning commission considered all pUblic testimony, <br />relevant exhibits and recommendations of the city staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The subject building is located in Valley Plaza <br />Shopping Center which is zoned "PUD-Commercial" and <br />has the characteristics of the City's Commercial <br />districts. Purposes of the commercial district <br />include: providing appropriately located areas for <br />retail stores, offices, and service establishments <br />offering commodities and services required by <br />residents of the city and its surrounding market <br />area, and providing opportunities for retail <br />stores, offices, and service establishments to <br />concentrate for the convenience of the public. The <br />proposed drive-through would meet these zoning <br />district purposes to the extent of providing a new <br />service to the community within an existing <br />shopping center. <br /> <br />Some of the objectives of the zoning ordinance are <br />to: foster a harmonious, convenient, workable <br />relationship among land uses, protect existing land <br />uses from inharmonious influences and harmful <br />intrusions, promote a safe, effective traffic <br />circulation system, and to ensure that pUblic and <br />private lands ultimately are used for the purposes <br />which are most appropriate and beneficial to the <br />City as a whole.
