<br />The project, as conditioned, requires the use to be <br />operated in a non-nuisance manner. other drive- <br />through restaurants within the City operate <br />satisfactorily under similar conditions. <br /> <br />The entrance to the drive-through lane is clearly <br />marked and does not interfere with on- or off-site <br />traffic patterns. As conditioned, the proposed <br />drive-through window will not have an adverse <br />effect on the North Pleasanton area's air quality, <br />and, therefore, meets the General Plan's air <br />quality guidelines. <br /> <br />c. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />As proposed and conditioned, the use complies with <br />all applicable regulations of the zone and PUD in <br />which it is located. <br /> <br />WHEREAS, a draft Negative Declaration was prepared for the Planned <br />Unit Development prior to its approval in 1989. The <br />proposed fast-food restaurant was addressed in that <br />document. The location, orientation and the proposed use <br />of the building pad area designated for the fast food <br />restaurant has not changed substantially since the <br />preparation of that Negative Declaration. Therefore, no <br />additional environmental evaluation is necessary; and <br /> <br />WHEREAS, the proposed drive-through restaurant is in complete <br />conformance with the building pad and drive-through lane <br />location as indicated on the approved PUD site plans. <br />The addition of a drive-through restaurant in this <br />location will serve the public benefit and is an <br />appropriate use within the retail center. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASAHTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case UP-91-27, the application of Pleasanton <br />Square Partners I for a conditional use permit to allow <br />a fast food restaurant with a drive through window <br />located at 6010 Johnson Drive subject to the conditions <br />shown on Exhibit "A" attached hereto and made part of <br />this case by reference. <br /> <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption <br />
