<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-91-44 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-91-27 FOR PLEASANTON SQUARE PARTNERS I <br /> <br />WHEREAS, Pleasanton Square Partners I has applied for a <br />conditional use permit to allow a fast food restaurant <br />with a drive through window located at 6010 Johnson <br />Drive; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Industrial, Commercial and Offices District; and <br /> <br />WHEREAS, at their duly noticed public hearing of June 26, 1991, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the city staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The subject use would be located within a retail <br />center, which has incorporated the uses and <br />standards of the City's C-C (Central Commercial) <br />district, which permits a variety of retail <br />establishments, and restaurants. The drive-through <br />restaurant is in accordance with the conditionally <br />permitted uses of this zoning district. An <br />objective of the commercial zoning districts is to <br />provide appropriately located areas for retail <br />stores, service establishments, etc., which offer <br />commodities and services required by City <br />residents. In addition, such uses are encouraged <br />to concentrate for the convenience of the public <br />and for mutual benefit. The location of this <br />drive-through restaurant on the site of a retail <br />home improvement center meets these objectives. <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />
