The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />The PUD-Central Commercial zoning of the subject <br />site allows the establishment of a dance studio <br />with a conditional use permit. As a project in a <br />suite on a developed site, the proposed location in <br />Hopyard village complies with the parking, setback <br />and other site development requirements contained <br />in the zoning ordinance and specific conditions of <br />the approval for the PUD. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act; <br />and <br /> <br />WHEREAS, as conditioned, the proposed conditional use is <br />appropriate to the site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case UP-91-25, the application of Sherri and <br />Peter Sweetnam for a conditional use permit to allow the <br />establishment and operation of a dance studio located at <br />3015 Hopyard Road, suite I, in a portion of the Hopyard <br />Village Shopping Center subject to the following <br />conditions: <br /> <br />1. The use shall conform substantially to the site <br />plan, details of operation, and related materials, <br />Exhibit A (dated "Received May 23, 1991"), on file <br />with the Planning Department. <br /> <br />2. If at any time in the future, it is determined by <br />the Planning Director that loud noises (both within <br />and outside the suite), parking problems, <br />loitering, and other problems associated with the <br />proposed use are having adverse effects on <br />surrounding uses or the city in general, the <br />Planning commission may review and, if necessary, <br />attach additional conditions or revoke the subject <br />conditional use permit. <br /> <br />3. The suite shall be soundproofed in the manner <br />prescribed by the City Building Official. The <br />soundproofing shall be installed prior to the <br />commencement of business and shall not permit a <br />noise level of 50 dba or greater from entering the <br />adjacent suites. <br /> <br />Resolution No. PC-91-43 <br />June 26, 1991 <br />
