<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUlilTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-91-43 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-91-25 FOR SHERRI AND PETER SWEETNAM <br /> <br />WHEREAS, Sherri and Peter Sweetnam has applied for a conditional <br />use permit to allow the establishment and operation of a <br />dance studio located at 3015 Hopyard Road, Suite I, in a <br />portion of the Hopyard village Shopping center; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned unit Development) <br />- C-C (Central Commercial) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of June 26, 1991, <br />the Planning commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />One of the objectives of the zoning ordinance is <br />to ensure that public and private lands are used <br />for the purposes which are most beneficial to the <br />city as a whole. As conditioned, the proposed use <br />is an educational service that would provide <br />recreational training to a wide segment of the <br />community. <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The dance studio would be operated in a manner <br />similar to the other retail/office/educational <br />users in the complex. As conditioned, all <br />potential adverse impacts resulting from the use, <br />i.e., noise, parking, etc., have been addressed by <br />the applicant and the city, so as to ensure that <br />the adjacent tenants would not be negatively <br />impacted. The proposed dance studio would add to <br />the economic vitality and diversity of the shopping <br />center, possibly contributing patronage to other <br />businesses in the center. <br />
