<br />PLANNING COMMISSION CITY OF PLEASAHTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-91-42 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-91-22 FOR DAVID AND DOLORES SANCHEZ <br /> <br />WHEREAS, David and Dolores Sanchez has applied for a conditional <br />use permit to operate an automotive body shop at an <br />existing facility located at 3687 Old Santa Rita Road; <br />and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- c-o (Commercial and Offices) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of June 12, 1991, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the city staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />One of the objectives of the zoning ordinance is to <br />ensure that public and private lands are used for <br />purposes which are beneficial to the city as a <br />whole. As conditioned, the proposed use would <br />provide a beneficial service to the community. The <br />proposed use, as conditioned, can be accommodated <br />on the project site and is compatible with other <br />automobile-related uses on the site and within the <br />immediate area. <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />As conditioned, all of the automobile body repair <br />activities shall be performed indoors. The <br />handling and storage of all hazardous materials <br />would be in accordance to the standards required by <br />the city. There would be no adverse impacts to the <br />air and water quality and circulation on the <br />project site or the surrounding properties. <br />
