<br />downtown uses. The applicant will also be required <br />to mitigate any future nuisances which may occur as <br />a result of the proposed use. Therefore, this <br />finding can be made. <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />Given the limitations on teenage use, the proposal <br />will not impact surrounding uses. The proposed use <br />will comply with applicable Building and Fire <br />Codes. Police Department staff have no objections <br />to the subject proposal. Based on the <br />aforementioned, the project will not be detrimental <br />to the public health, safety, or welfare and this <br />finding can be made. <br /> <br />C. The proposed conditional use will comply with each <br />of the provisions of the Zoning Ordinance. <br /> <br />As conditioned, the proposed use will <br />all provisions and requirements of <br />zoning ordinance. <br /> <br />comply with <br />the City'S <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act; <br />and <br /> <br />WHEREAS, as conditioned, the proposed conditional use is <br />compatible with the surrounding uses and properties. <br />Conditions of approval have been included which will <br />ensure that the safety and general welfare of the <br />surrounding area is maintained. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case UP-91-21, the application of Phillies <br />Cheesesteak for a conditional use permit to operate a <br />game arcade within a restaurant to be located at 310 Main <br />street subject to the conditions shown on Exhibit "A" <br />attached hereto and made part of this case by reference. <br /> <br />section 2. This resolution shall become effective 15 days after <br />its passage and adoption <br /> <br />Resolution No. PC-91-41 <br />June 12, 1991 <br />
