<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-91-41 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-91-21 FOR PHILLIES CHEESESTEAK <br /> <br />WHEREAS, Phillies Cheesesteak has applied for a conditional use <br />permit to operate a game arcade within a restaurant to be <br />located at 310 Main street; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- C-C (Central Commercial) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of June 12, 1991, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Some of the objectives of the zoning ordinance are <br />to foster a harmonious, convenient, workable <br />relationship among land uses, protect existing land <br />uses from inharmonious influences and harmful <br />intrusions, and to insure that public and private <br />lands are used for the purposes which are most <br />appropriate and beneficial to the city as a whole. <br />The proposal would be consistent with these <br />objectives. <br /> <br />The game arcade would be an ancillary use to the <br />principal restaurant use. By requiring minors to <br />be patrons of the restaurant, the potential for the <br />use to become a teenage "hang-out" is eliminated. <br />Thus, the game arcade will not create "inharmonious <br />influences and harmful intrusions" on the <br />surrounding businesses. The EI Portal restaurant <br />is located within the same building and staff has <br />not received complaints regarding the operation of <br />that use. The proposal will not alter the exterior <br />of the building. Due to similar characteristics <br />with other restaurant uses in the area, the <br />proposal should not interfere with the surrounding <br />uses' ability to operate. As conditioned, the <br />proposed use will be compatible with adjacent <br />
