PLANNING COMMISSION CITY OF PLEASAHTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-91-36

RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER
CASE UP-91-11 FOR DOUG AHBOLTIN/AHBOLTIN CONSTRUCTION

WHEREAS, Doug Ahboltin has applied for a conditional use permit to
construct an approximately 640 square foot second unit in
conjunction with a new single-family residence to be
located at 4089 vineyard Avenue; and

WHEREAS, zoning for the property is RM-4, 000 (Mul tiple-family
Residential; and

WHEREAS, at their duly noticed public hearing of May 22, 1991, the
Planning commission considered all public testimony,
relevant exhibits and recommendations of the city staff
concerning this application; and

WHEREAS, the Planning commission made the following findings:

A. That the proposed location of the conditional use
is in accordance with the objectives of the zoning
ordinance and the purpose of the district in which
the site is located.

The zoning for the property is RM-4, 000, which
permits single-family and mUlti-family residences.
In addition, state law requires that local agencies
permit the construction of a second-unit in
residential zones, where such structure can meet
all setbacks and other zoning regulations
pertaining to the location of the structure on the
property.

The request to establish a second unit in
conjunction with the construction of a new single-
family residence meets the objectives of the zoning
ordinance and the purpose of the RM-4,OOO (Multi-
Family Residential) district.

A stated objective of the multi-family (RM)
districts is to preserve as many of the desirable
characteristics of single family residential
districts as possible, while permitting higher
densities. The creation of a second unit with the
new single-family dwelling achieves this objective
because it does present the appearance of a single-
family lot. The objective of adequate light, air,
privacy and open space is met with the preservation
of the fairly large rear yard area and construction

II

I
