<br />PLANNING COMMISSION CITY OF PLEASAHTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-91-36 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-91-11 FOR DOUG AHBOLTIN/AHBOLTIN CONSTRUCTION <br /> <br />WHEREAS, Doug Ahboltin has applied for a conditional use permit to <br />construct an approximately 640 square foot second unit in <br />conjunction with a new single-family residence to be <br />located at 4089 vineyard Avenue; and <br /> <br />WHEREAS, zoning for the property is RM-4, 000 (Mul tiple-family <br />Residential; and <br /> <br />WHEREAS, at their duly noticed public hearing of May 22, 1991, the <br />Planning commission considered all public testimony, <br />relevant exhibits and recommendations of the city staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The zoning for the property is RM-4, 000, which <br />permits single-family and mUlti-family residences. <br />In addition, state law requires that local agencies <br />permit the construction of a second-unit in <br />residential zones, where such structure can meet <br />all setbacks and other zoning regulations <br />pertaining to the location of the structure on the <br />property. <br /> <br />The request to establish a second unit in <br />conjunction with the construction of a new single- <br />family residence meets the objectives of the zoning <br />ordinance and the purpose of the RM-4,OOO (Multi- <br />Family Residential) district. <br /> <br />A stated objective of the multi-family (RM) <br />districts is to preserve as many of the desirable <br />characteristics of single family residential <br />districts as possible, while permitting higher <br />densities. The creation of a second unit with the <br />new single-family dwelling achieves this objective <br />because it does present the appearance of a single- <br />family lot. The objective of adequate light, air, <br />privacy and open space is met with the preservation <br />of the fairly large rear yard area and construction <br /> <br />II <br /> <br />I <br />
