<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-91-23 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE MAJOR MODIFICATION <br />FOR CASE PUD-89-6-3M, THE APPLICATION OF SPIEKER PARTNERS <br /> <br />WHEREAS, Spieker Partners has applied for a major modification to <br />the approved planned unit development (PUD-89-6) for Rose <br />Pavilion (Phase III), located at the northwest corner of <br />Santa Rita Road and Rosewood Drive, to permit banners, <br />balloons, and pennants in conjunction with grand openings <br />and special events if found to be in conformance with the <br />City's provisions for temporary conditional use permits; <br />and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Commercial District; and <br /> <br />WHEREAS, <br /> <br />at their duly noticed hearing of March 27, <br />Planning Commission considered all public <br />relevant exhibits and recommendations of the <br />concerning this application; and <br /> <br />1991, the <br />testimony, <br />City staff <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />CEQA); and <br /> <br />WHEREAS, the Planning Commission finds that approval of the <br />applicants' request to modify Condition Number 2 of the <br />PUD is reasonable since it would give the applicants the <br />same opportunity to use temporary signs and decorations <br />on a restricted basis as almost all other shopping <br />centers in the city. Furthermore, it is believed that <br />the intent of the original PUD condition was primarily to <br />prevent the use of banners, flags, etc. on a regular, on- <br />going basis and not necessarily to preclude grand <br />openings and promotional events. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Recommends approval of Case PUD-89-6-3M, the <br />application of Spieker Partners for a major modification <br />to the approved planned unit development (PUD-89-6) for <br />Rose Pavilion (Phase III), located at the northwest <br />corner of Santa Rita Road and Rosewood Drive, to permit <br />banners, balloons, and pennants in conjunction with grand <br />openings and special events if found to be in conformance <br />with the city's provisions for temporary conditional use <br />permits subject to the following conditions: <br />
