<br />24. The developer shall contribute funds toward acquisition of one <br />heavy patrol vehicle and one-half of a water tender for the <br />Fire Department, the estimated 1990 costs of which total <br />$237,000. The developer's pro-rata share is estimated at a <br />not-to-exceed amount of 40.2 percent, or $95,300. <br /> <br />25. Park improvements shall occur in conjunction with grading and <br />construction phasing. The private park shall be improved <br />during Phase I of construction (Lots 30 - 49). Improvements <br />for the park staging area, the smaller public park near the <br />existing water tank and the hiking trails shall occur during <br />Phase II of grading. All pUblic park improvements and hiking <br />trails shall be to the satisfaction of the Director of <br />Community Services. <br /> <br />26. The design of the public parks, park access and facilities <br />shall be approved by the Park and Recreation Commission, prior <br />to city council approval of the Final Map. <br /> <br />27. All public park areas, park access areas and Lot E shall be <br />dedicated to the City prior to City council approval of the <br />Final Map. Said offer of dedication shall be approved as to <br />form by the City Attorney. <br /> <br />28. The Final Map shall show a dedicated easement for public <br />access over the hiking trails in all open space areas of the <br />property not dedicated to the city. The final width of this <br />easement shall be determined by the Director of Community <br />Services. Said offer of easement shall be approved as to form <br />by the City Attorney. If it is determined by the city Council <br />(through adoption of a hillside open space policy) that the <br />City shall not bear responsibility for trail maintenance, the <br />homeowners' association shall bear full and sole <br />responsibility for the maintenance of all the public trails. <br /> <br />29. The Final Map shall indicate a buffer area behind Lots 1 - 6 <br />and adjacent to the park staging area, which shall be included <br />as part of Lot F. The homeowners' association shall bear sole <br />and full responsibility for the maintenance of this area. <br /> <br />30. The final design for the private park area shall be subject to <br />the review and approval of the Planning Director prior to City <br />Council approval of the Final Map. <br /> <br />31. Prior to City Council approval of the Final Map, the applicant <br />shall submit design guidelines for the three custom lots for <br />approval by the Planning commission.
