<br />20. A concrete V-ditch shall be installed in the open space area <br />at the rear of all lots, as determined by the City Engineer, <br />to collect the surface water from the hillside. Lot lines <br />between the open space hillside area and private lots shall be <br />adjusted to provide a positive flow in the concrete V-ditches <br />located at the top of the slope bank with these ditches <br />located within open space areas. <br /> <br />21. Except for the swale located in lot 50C, all natural swales <br />shall be within the open space area. All private lot lines <br />shall have a minimum of 10' separation from the flowline of a <br />natural drainage swale. <br /> <br />22. Sliver fill shall not be used to create graded lots. <br /> <br />23. The maximum street grade shall be 12%. The maximum grade at <br />street intersections except Bernal Avenue shall be 7%. <br /> <br />24. Any lot with a pad elevation greater than 540' shall be <br />provided with a domestic booster pump which will maintain a <br />minimum operating water pressure of 40 psi. Individual lot <br />booster pumps shall be installed as necessary by the developer <br />on all but the custom lots. Custom lot owners shall provide <br />their own, as necessary. The developer shall disclose to all <br />prospective buyers of the custom and split pad lots with a pad <br />grade greater than elevation 540' that the water pressure <br />delivered to the lot on an average day may be less than 40 <br />psi. for these lots. This notice shall be reviewed and <br />approved by the City Attorney prior to the sale of any unit in <br />this project. This notice shall be included in all deeds to <br />affected individual properties. <br /> <br />25. The developer shall dedicate to the City a 20 foot strip of <br />land next to the existing lot at the top of Abbie street <br />(north side), the length of which shall be the same as that <br />existing lot's depth. The developer shall construct a 12 foot <br />paved road within this parcel for public access to the <br />existing sewer main. Lots 115 and 109 shall be reconfigured <br />as necessary to accommodate this access way. <br /> <br />26. The developer shall install a traffic signal at the <br />intersection of Bernal Avenue and Independence Drive. The <br />developer may enter into a reimbursement agreement with the <br />City to recover pro-rata reimbursement from other benefitting <br />undeveloped properties. The area of this reimbursement <br />district shall be established prior to the approval of the <br />final map. <br /> <br />27. The developer shall pay a pro-rata share of the construction <br />of the Bernal Avenue extension through the Stanley Business <br />Park as required in a previous reimbursement agreement between <br /> <br />Resolution No. PC-91-19 <br />March 13, 1991 <br />
