<br />Resolution No. PC-9l-l0 <br />Page 8 <br /> <br />If this area is not transferred to the Lemoine property, the <br />applicant shall grant an access easement to Lemoine for his <br /> <br />existing driveway. A barricade shall <br />maintained at the terminus of "C" street, <br />that Lemoine desires access to "C" street, <br />and receive approval from the city. <br /> <br />be installed and <br />and, in the event <br />he must apply for <br /> <br />17. The residence to be located on Lot 35 shall be one-story and <br />not exceed 22 feet in height as measured from the highest part <br />of the roof to the lowest exterior elevation that the <br />structure intersects. <br /> <br />18. The developer shall be responsible for physically closing the <br />access to the Woods, Lemmons; Hempy et al subdivision <br />following installation of the replacement street/driveway. <br />Should any claim arise over the City's closing of the Woods, <br />Lemmons, Hempy et al driveway, the developer shall be <br />responsible for indemnifying the city for any and all costs <br />associated with making said closure permanent. <br /> <br />20. The developer shall design and construct a bus pUll-out and <br />shelter as part of the Foothill Road improvements to be <br />completed as determined by the City Engineer. The design and <br />location, proximate to the northern entrance road to the <br />development, of this bus pUll-out and shelter shall be <br />subject to the review and approval of the City Engineer. <br /> <br />21. The final landscape plan for the open space areas and street <br />trees shall be reviewed and approved by the Design Review <br />Board prior to the recordation of the final map. The Design <br />Review Board may require additional cross-sections be provided <br />through Lots 35-39 in order to determine the number of trees <br />necessary to prevent structures on these lots from being <br />visible from Foothill Road. Additional trees may be required <br />in the open space area to screen the residences on these lots. <br /> <br />22. The project improvements shall not be phased, nor multiple <br />final maps filed. All subdivision improvements shall be <br />completed and accepted by the City Council prior to occupancy <br />of any of the lots. The developer shall designate the lots <br />which have Growth Management approval in 1991 and those which <br />are approved for 1992. These designations shall be included <br />in the project CC&R's unless the Planning Director approves <br />the deletion due to no units to be builtl occupied prior to <br />1992. <br />
