<br />shall incorporate the following conditions: <br /> <br />a. Long term parking is prohibited adjacent to the garages <br />and within the private driveways. No overnight parking <br />is allowed. Boats and recreational vehicles shall not be <br />parked within the subject development. <br /> <br />b. There shall be no parking of occupants cars within the <br />guest parking spaces of the townhome development. <br /> <br />c. The homeowner's association shall be responsible for the <br />care and maintenance of all commonly owned landscape <br />areas. <br /> <br />d. The garage parking spaces shall be maintained <br />unobstructed and available for parking of vehicles. <br /> <br />7. That the developer shall establish a homeowners association <br />through the CC&R's for the project. The association shall be <br />responsible for maintaining all common open space, private <br />utilities, private streets, project walls, and other common <br />areas and improvements within the development. The City shall <br />be granted the rights and remedies of the association, but not <br />the obligation, to enforce the maintenance obligations. The <br />City Attorney shall review and approve the proposed CC&R's <br />prior to the recordation of a final subdivision map for the <br />project. <br /> <br />8. The front yard area of the detached units shall be equipped <br />with automatic low-flow irrigation systems. Rear yard <br />irrigation stub outs and controllers shall be provided to the <br />satisfaction of the Planning Director prior to occupancy. <br /> <br />9. Development standards for accessory structures for the entire <br />development shall be submitted to the Planning Director for <br />review and approval prior to the issuance of any final map. <br /> <br />10. Detail plans of the tot lot to be submitted to the Design <br />Review Board prior to any final map approval. Play equipment <br />shall be installed prior to occupancy of any units. <br /> <br />11. The proposed soundwall in terms of design and material shall <br />match the existing soundwall to the east. The noise <br />mitigation measures contained within the acoustical report <br />prepared by Charles M. Salter Associates, dated September 28, <br />1990, shall be included in the design of the buildings. <br /> <br />12. That a minimum of 6 of the townhome units within the project <br />shall be sold to owner-occupant home buyers whose incomes do <br />not exceed the "moderate income" level (Le. no more than 120% <br />of the median income level for the Alameda and Contra Costa <br />county areas) as described in the Planning Commission staff <br />report.
