He concluded that Shapell will be
responsible for maintaining the open space until the City accepts the land.

THE PUBLIC HEARING WAS CWSED.
Commissioner Michelotti initiated a discussion on open space. She felt there would be very
limited public open space on the project site.

Commissioner Horan noted that information points to the idea that there will be no camping,
no picnicking, no trails, etc. His personal feeling was that because of the steep terrain that it
was the City's responsibility to maintain the open space. He felt that in the light of the Oakland fires that
every precaution should be taken for protection.

Chairman Mahem agreed with Commissioner Horan's comments and felt the City should
maintain the open space.

Commissioner Hovingh expressed some concern about the high cost of liability insurance to
the City.

~

A motion was made by Commissioner Mahem, seconded by Commissioner McGuirk making
the required tentative map findings for the proposed subdivision as listed in the staff report;
making the finding that the tentative map and grading plan are in substantial conformance
with the approved PUD development plan and conditions of approval for this site; and
approving Case T-6483 subject to the conditions listed in Exhibit "B" and the Standard
Conditions for Tentative Maps, with the following modification:

o That the open space to be dedicated to the City, which is identified as Site A
open space, be maintained by the City.

ROLL CALL VOTE:
A YES: Commissioners Horan, Hovingh, McGuirk, Michelotti, and Chairman Mahem
NOES: None
ABSENT: None
ABSTAIN: None

Resolution No. PC-91-79 was entered and adopted approving Case Tentative Tract Map 6483
as motioned.

GP-91-8.
