<br />Resolution No. PC.91.76 was entered and adopted recommending approval of the Negative <br />Declaration prepared for Case PUD-9l-2 as motioned. <br /> <br />A motion was made by Commissioner Hovingh, seconded by Commissioner McGuirk finding <br />that the project is consistent with the PUD District considerations; and recommending <br />approval of Case PUD-9l-2 subject to the conditions listed in Exhibit B with the following <br />modifications: <br /> <br />o Condition 4 - That the height of the house should be 24 ft.; <br /> <br />o Condition 5 - That the term "visible from Foothill Road" be deleted; <br /> <br />o Condition 16 - Shall read "No accessory structures or solid fences, as defined <br />by the Municipal Code, shall be located within the 150 ft. setback from <br />Foothill Road"; <br /> <br />o Condition 37 - That the applicant be allowed to pay his contribution to the City <br />at the Tentative Map stage (delete the words "upon demand"); <br /> <br />o Condition 28 - Delete; Replace with a condition stating the removal of the <br />easement to the rear of the Starnes property, which lies in front of Lot 3. <br /> <br />ROLL CALL VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Hovingh, McGuirk, Michelotti, and Chairman Mahem <br />Commissioner Horan <br />None <br />None <br /> <br />Resolution No. PC-91-77 was entered and adopted recommending approval of Case <br />PUD-91-2 as motioned. <br /> <br />PUD-89-1-1M.
