Kentuckv Fried Chicken <br />Application for a conditional use pennit to construct a drive-through window and lane <br />at an existing fast-food restaurant located at 1803 Santa Rita Road. Zoning for the <br />property is PUD (Planned Unit Development) - Commercial District. <br /> <br />Mr. Swift presented the staff report recommending denial of Case UP-91-14. <br /> <br />Commissioner Hovingh asked Mr. Swift for clarification as to a third left lane heading east <br />to Valley Avenue from Santa Rita Road. Mr. Swift said Council has not approved this at the <br />present time, but are considering it. <br /> <br />,'- <br /> <br />In response to Chairman Mahern's question, Mr. Swift said the problem is only in the <br />evening peak hours in making a left turn to head east from the area of Kentucky Fried <br />Chicken. <br /> <br />THE PUBLIC HEARING WAS OPENED. <br /> <br />Randall Cavanagh, architect, 909 14th Street, Modesto, represented the application. He <br />stated he has read the staff report and even though he felt it was negative, they had covered <br />all the bases. He addressed several items: he felt parking is adequate as is; they would be <br />willing to move the existing tree and replant it or put a different one in order to use the <br />space. As far as circulation of traffic, Mr. Cavanagh did not think a drive-through would <br />generate that many more people, but would simply serve their existing customers more <br />efficiently. He said Kentucky Fried Chicken establishments are geared to serving their drive- <br />through customers first in order to eliminate any problem with traffic. <br /> <br />Mr. Randall said their peak hours are from 6 p.m. to 10 p.m. He expressed a desire for the <br />Shell station to either sell or allow them use of a portion of their property for a driveway; <br />however, they do not appear to be agreeable to that at this time. In regard to landscaping, <br />they would lose 10 ft. on the side for a drive-through, but they would plan to enhance the <br />existing landscaping.
