He said he would not want to have to pay for extra liability insurance because of the facility. He said the issue is that Ms. Whitbeck is working away from her home most of the day; he was also concerned with the number of children allowed. Commissioner Hovingh asked Mr. Zurich what he would do if this were simply a family of 12 children. Mr. Zurich said the CC&R's would not have allowed a family of that size to purchase the home. Ms. Whitbeck returned to the podium. She said she also has spoken with Elaine Arrington of the State Department about her facility and Ms. Arrington had no problem with it. She has also spOken to the parents of those children that she cares for and they had no problem with her working when the children are not there. She said she has tried to explain to the neighbors how the situation will work so they are aware of the facts. She said she does carry additional liability insurance and did not think Mr. Zurich should be concerned. She assured the Commission she would not let the children "bake" in the heat all summer, but would take them to the pool or other places of amusement like Great America. She said she would not allow the children to damage the Heritage Oak, but might want to put a rope swing on it. She said she did not know that she needed a ~ conditional use permit until she was advised of this by Resources for Family Development, and had no intention of operating illegally. As far as the bus stop, she said she drives the children to the bus stop and waits until they leave. In addition, she said she is the sole person who waits until the bus leaves. Chairman Mahern asked if all the children leave when Ms. Whitbeck leaves. Ms. Whitbeck said the children go with her when she leaves at 7:50am. THE PUBLIC HEARING WAS CLOSED. Commissioner Hovingh commented that a Human Services report noted that about 800 spaces were needed for child care in the 9-10 age bracket in the Valley. State law encourages day care so children will not have to stay alone while their parents are still at work. He did not think it would affect the value of homes if a day care is in the area and did not think the noise would be bad at all. He supported the application. Commissioner Michelotti agreed with Commissioner Hovingh's comments. She would encourage the neighbors to work with Ms. Whitbeck as facilities are definitely needed. She did not think the noise would be that bad even if there are 12 children; she felt the neighbors would have to overlook a little noise.
