He felt the applicant is <br />already bound by Condition 9 of the PUD. <br /> <br />commissioner Michelotti discussed with Mr. 'Quaglia how <br />maintenance of the open space would be handled. Mr. Quaglia said <br />that a fire hydrant is anticipated to be put in at the end of <br />every street that faces the open space; underbrush will be <br />cleaned out and a buffer zone be put in between the upper lots <br />and the open space area. They have also created two access <br />points for emergency vehicles and will continue to investigate <br />this issue until the final map. This would be contingent upon <br />what the City wishes to do with the upland area. <br /> <br />Commissioner Michelotti asked Mr. Quaglia to address fencing. <br />Mr. Quaglia said Design Review Board took action to approve a <br />fence design; however, they must go back before DRB for a final <br />landscape plan. Individual fencing plans will be looked at with <br />each house. <br /> <br />commissioner Hovingh referred to Condition 30 and asked if <br />sidewalks could be extended to the boundary of the Lemoine <br />property. Mr. Quaglia said they are shown as going all the way <br />to the Lemoine property. <br /> <br />THE PUBLIC HEARING WAS CLOSED. <br /> <br />Chairman Mahern asked staff to address the applicant's request to <br />delete Condition 28. Mr. Swift said the PUD was written at a <br />time when staff was not aware of what Council's policy decision <br />was going to be with respect to the trails. The Council just <br />made that decision last week and that is the reason the condition <br />showed up in this manner. The Council has adopted a policy to <br />investigate the feasibility of a trail system that goes along the <br />foothills of Pleasanton ridge rather than a trail system at the <br />top of the ridge. Staff is directed to try and work with <br />property owners to try and develop a publicly usable trail <br />system. Mr. Swift continued to say that they now have a mandate <br />from Council that they would like the Presley project to the <br />north and the Yee project to the south to have a trail system <br />incorporated. Mr. Swift noted that the applicant has stated <br />tonight that the original PUD condition is broad enough to <br />include construction of the trail by the applicant. <br /> <br />Mr. swift said staff can work with the applicant in regard to <br />Condition 28. <br /> <br />Commissioner Horan asked if the Parks and Recreation Department <br />can work with property owners to get something settled in regard <br />to a future trail system.
