<br />Commissioner McGuirk will support the application with the additional conditions covering <br />the noise and loitering issues. He feels it should be up to the aerobic instructor to control <br />the music volume. He also believes loitering will not be an issue if the instructor can control <br />the loitering during the open parking lot hours by having the children wait inside for their <br />parents, as well as by having adult-only classes after 7:30 p.m. <br /> <br />Chairman Wright clarified with staff that Condition 4 restricting classes to ten students age <br />16 and older was written to mitigate parking problems. Staff stated that was the intent, but <br />the condition could be relaxed for the evening class. Chairman Wright supports the <br />application with the revised condition, and feels the loitering will not be a problem because <br />of the availability of the waiting area and that Mr. Abigana will keep on top of a <br />loitering/noise problem. <br /> <br />In response to Commissioner Barker, Mr. Swift stated it is the responsibility of the Center's <br />management to lock the gate. <br /> <br />Commissioner Hovingh stated he would like to add to Condition 2 that aerobic classes will <br />not be held after 6 p.m. <br /> <br />Commissioner McGuirk motioned, seconded by Cornrni..~ioner Hovingh, making the <br />conditional use permit fmdings and approving Case UP-94-S2 subject to the conditions <br />listed in Exhibit B with the following modifications: <br /> <br />Condition 2: Add: No aerobic classes shall be held after 6 p.m. <br /> <br />Condition 4: Classes shall be limited to 20 students plus one instructor. At no <br />time shall there be more than 10 students over 16 years of age prior <br />to 7 p.m. After 7 p.m., there shall be no students under the age of <br />16 unless accompanied by an adult enrolled in the same class. <br /> <br />ROLL CALL VOTE <br />AYES: Commissioners Barker, Hovingh, Lutz, McGuirk, and Chairman Wright <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Resolution No. PC-94-57 was entered approving UP-94-52, as motioned. <br /> <br />t..
