<br />~ Chairman McGuirk inquired if Mr. Chan had read and agreed with the staff report and <br />conditions. Mr. Chan stated he agrees to the report. <br /> <br />Wayne Pesuit, 7 Deer Oaks Drive, showed a slide presentation of the eucalyptus trees at 1 <br />Deer Oaks Drive and in the subdivision. He advised that he has eucalyptus trees on his <br />property, although they are not as close to his house as Mr. Chan's. Mr. Pesuit feels that if <br />Tree #1 is removed, it will leave a gaping hole in the continuity of the tree grove. <br /> <br />The speaker urged the Planning Commission to review all available alternatives and urged <br />the Commission to save the four trees. <br /> <br />John Pesuit, 7 Deer Oaks Drive, stated that at the time they bought their home, the three <br />trees in the front of the house had been marked to be removed. However, they were not <br />removed, and the trees are now a problem today. The speaker feels the problem could have <br />been resolved years ago if the house had been relocated on the lot away from the trees. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />With regard to a letter of opposition received from the property owner at 12 Deer Oaks <br />Drive, Chairman McGuirk inquired if staff had an opportunity to review the tree situation at <br />12 Deer Oaks and were they in the same situation as 1 Deer Oaks Drive. Staff recalled that <br />they do not have eucalyptus trees on the lot and feels they are concerned about the visual <br />impact of removing the four trees. <br /> <br />Commissioner Barker inquired how tall is a 36" box tree. Staff stated they are generally 10- <br />12 feet in height, believing oak trees would be preferable to redwood trees because they are <br />indigenous to the area. <br /> <br />Commissioner Wright inquired of staff why the three trees were not removed at the time of <br />the subdivision development. Mr. Iserson imagined that City staff advised that the trees <br />were heritage trees and could not be removed. <br /> <br />Commissioner Wright concurs with the staff report and understands Mr. Pesuit's concern <br />about the visual impact to his property. However the safety issue to Mr. Chan remains and <br />the Homeowners Association has agreed to the removal. He further believes that the <br />addition of oak: trees will mitigate the visual impact from Foothill Rd. Commissioner Wright <br />recommends to either delete Condition 2 or modify it to require an explanation of the City's <br />decision be made to the Homeowners Association by Mr. Chan. <br /> <br />Commissioner Barker commends the applicant for seeking the Homeowner Association's <br />permission. She feels that redwood trees would be a better choice for replacement trees. <br /> <br />Commissioner Lutz feels this situation should have been handled differently years ago and <br />believes the staff report is a prudent way to handle this safety issues raised. <br /> <br />Planning Commission Minutes <br /> <br />Page 4 <br /> <br />June 8, 1994 <br /> <br />" <br /> <br />- <br />
