<br />~ <br /> <br />Mr. Beougher advised the Commission that a bond is traditionally given for a one year <br />period, thus the time limit would be two years plus three months. The Commission <br />discussed if the deadline should be moved up three months earlier so the final deadline ended <br />at 24 months. <br /> <br />Mr. Swift stated it would be satisfactory to staff to keep the September 1, 1995, deadline. If <br />a bond is posted and construction has begun by that time, the City is assured that if they <br />suddenly stopped work, the bond would be in place for the City to finish the road <br />construction. <br /> <br />A motion was made by Comm;l<~ioner Mahern, seconded by Comm;l<~ioner Michelotti, <br />recommending approval of Case PUD-91-19-1M, modification for a three year extension <br />to the applicant obtaining the building permit as long as the road serving the lot is <br />constructed by September 1, 1995, subject to the conditions of approval listed in Exhibit <br />"B," modifying: <br /> <br />Condition 6: Road construction must be started by September 1, 1995, and if the <br />road construction is not completed by September 1, 1995, a bond must be in place for <br />the full amount of the construction costs. <br /> <br />Condition 8: At no time shall a tennis court or sportcourt be constructed on the <br />proposed lot (Lot S). <br /> <br />Condition 14 of the Standard Conditions: Delete. <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Hovingh, Mahem, Michelotti, Wright, and Chairman McGuirk <br />None <br />None <br />None <br /> <br />Resolution No. PC-94-24 was entered and adopted recommending approval of Case <br />PUD-91-19-1M as motioned. <br /> <br />**Mr. Gint A Federas approached the Recording Secretary inquiring if his application had <br />been acted upon. Chairman McGuirk advised him that the application had been approved, <br />although he inquired if the Sylvan Learning Center would operate during the Christmas <br />holidays.
