~ Mr. Beougher advised the Commission that a bond is traditionally given for a one year period, thus the time limit would be two years plus three months. The Commission discussed if the deadline should be moved up three months earlier so the final deadline ended at 24 months. Mr. Swift stated it would be satisfactory to staff to keep the September 1, 1995, deadline. If a bond is posted and construction has begun by that time, the City is assured that if they suddenly stopped work, the bond would be in place for the City to finish the road construction. A motion was made by Comm;l<~ioner Mahern, seconded by Comm;l<~ioner Michelotti, recommending approval of Case PUD-91-19-1M, modification for a three year extension to the applicant obtaining the building permit as long as the road serving the lot is constructed by September 1, 1995, subject to the conditions of approval listed in Exhibit "B," modifying: Condition 6: Road construction must be started by September 1, 1995, and if the road construction is not completed by September 1, 1995, a bond must be in place for the full amount of the construction costs. Condition 8: At no time shall a tennis court or sportcourt be constructed on the proposed lot (Lot S). Condition 14 of the Standard Conditions: Delete.
