<br />~ <br /> <br />Lynn Ann Sorensen, 4432 Foothill Road, requested the water line be included in the road <br />design approval. Staff stated the road design does accommodate the water line. Staff further <br />commented that although it makes more sense to install the water line during the road <br />construction, the City cannot make the property owners put in water lines and connect to the <br />City water system. <br /> <br />Frank Lehne, 5466 Foothill Road, stated he feels it is very important to have the private <br />road's blind spots removed. He believes the road improvements are minor, and he also <br />would like the water line put in the road shoulder at the time of the road construction. He <br />stated he will work with Mr. Glenn and the other users to draft an agreeable road <br />construction plan. <br /> <br />Martha (Marty) Greist, 5470 Foothill Road, responded to the PUD appeal. She stated that <br />adding the water line location to the map was an oversight on her part. She stated it has <br />been their goal to hook into the City water system. In response to the accuracy of the map, <br />Ms. Greist knew the map is somewhat outdated and the site points are off by a few feet. She <br />stated the Moller Property developers have agreed to pay for the asphalt, and the subbase <br />aggregate will be to the same standards as used in the lower portion of the road. A <br />professional grader will also be used. Ms. Greist believes the issue of good drainage has <br />been addressed in all areas of this project. Regarding the East Bay Regional Park District <br />property, Ms. Greist stated that the easement has been litigated several times and the exact <br />location of the easement is in question. Ms. Greist advised the Commission that the current <br />agreement with the MoIlers is that wherever the road is constructed, the MoIlers want that <br />position of the road easement recorded on everyone's title in order to mitigate any future <br />easement questions. <br /> <br />Responding to Commissioner Mahern, Ms. Greist stated no grading will be done around the <br />subject oak tree. <br /> <br />PUBLIC HEARING WAS CWSED <br /> <br />The Commissioners stated their belief that the City has no jurisdiction over private roads, <br />that the proposed modifications are an improvement to the existing road, and they would <br />hope the property owners could work out any problems among themselves. <br /> <br />A motion was made by Commi...~ioner Hovingh, seconded by Commi......ioner Wright, <br />rmding the proposed driveway improvements are consistent with the Moller Ranch PUD <br />development plan. <br /> <br />ROLL CALL VOTE <br />A YES: Commissioners Hovingh, Michelotti, Mahern, Wright, and Chairman McGuirk <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />~ <br /> <br />Planning Commission Minutes <br /> <br />Page 4 <br /> <br />April 27, 1994 <br />
