"-

Regarding the condition concerning a water and oil separator, the applicant stated he initially
didn't agree to it because he didn't understand it.

Commissioner Michelotti ascertained with the applicant that the one year limit is acceptable.

Commissioner Wright verified with the applicant that no cars will be left outside the gate
after 8 p.m.

Linda Adams, 159 Ray Street, stated her concern that no sealer is required on the gravel.
She stated that even new cars lose large quantities of fluid, and she is against the applicants
self-policing themselves. She would prefer the gravel sealed because she does not want
pollutants affecting the water table and the environment.

Chairman McGuirk stated his concern with the number of vehicles stored and the fact that
damaged cars would tend to leak some type of engine fluid, even well-maintained cars
develop leaks periodically. Mr. Higdon stated staff feels the situation is controllable and is
comfortable that if a leak occurs, it is better to clean up the leakage area than to put down
two layers of oil covering 60,000 square feet over the parking lot. Further, he stated the
application could be conditioned to be inspected during October (i.e., before the rains) to
verify that no leakage problems exist.

PUBLIC HEARING WAS CWSED

Commissioners Wright and Mahern stated their approval of the suggestion for the October
inspection. Staff stated the inspection condition could be added to Condition 10.

A motion was made by Commissioner Hovingh, seconded by Commissioner Wright,
making the conditional use permit f"mdings and approving Case UP-94-05 as modified:

Condition 10: accepting the revised Condition 10 of April 13, 1994, as well as
adding an October inspection.

Condition 14: a fence to be installed to prohibit parking vehicles within the oak
tree dripline.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Hovingh, Michelotti, Mahern, Wright and Chairman McGuirk
None
None
None

Resolution No. PC-94-16 was entered and adopted approving UP-94-05 as motioned.

Planning Commission Minutes

Page 8

April 13, 1994
