<br />c. UP-94-0S. American Bankers Accentance Cornoration <br />Application for a conditional use permit to allow warehousing of repossessed <br />automobiles at the outdoor lot located at 3878 Stanley Boulevard. Zoning for the <br />property is C-S (Commercial-Services) District. <br /> <br />Mr. Iserson presented the application of Case UP-94-5 requesting the approval of an outdoor <br />storage lot for repossessed automobiles and light duty trucks, subject to the attached <br />conditions of approval in Exhibit "B." The cars are in relatively good condition. No retail <br />sales will take place at the site. This is an interim use site until the Del Valle Parkway <br />extension is developed. A one year lease is in effect, however, the applicant would like to <br />be able to extend the lease beyond that time. Staff feels there will be no impact to the <br />surrounding properties. Fencing and a former walnut grove provide adequate screening. <br />Leakage of fluids is not expected from the vehicles, therefore staff feels the use of the <br />existing gravel is sufficient if it is maintained. Mr. Iserson noted the revised Condition 10 <br />distributed to the Commission. <br /> <br />Commissioner Wright inquired what "extensive body damage" entailed and whether the <br />applicants would police themselves to ensure no fluid leakage. Mr. Iserson cited Condition <br />15 which prohibits any repairs from being done on the site. Staff feels with these two <br />conditions, there will be no on-site repair. <br /> <br />Commissioner Michelotti inquired why the change in hours from 8-6 and 8-8. Mr. Iserson <br />feels the intent is to take advantage of the daylight hours. <br /> <br />Commissioner Hovingh inquired if in the event of any leakage, the applicant could be <br />conditioned to perform the environment clean-up. Mr. Beougher stated the owner and/or <br />subsequent owner is responsible for any environmental clean up. Referring to Condition 14 <br />which states no autos are to be parked within the dripline of the oak tree, Commissioner <br />Hovingh inquired if a fence should be put up at the drip line of the tree. Mr. Iserson <br />responded that this could be conditioned. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Bob Ferreira, represented the applicant and the property owner. He agrees to the conditions <br />of approval as well as to protecting the dripline of the oak tree. <br /> <br />Bob Obra stated the proposed hours are acceptable. In response to Commissioner Hovingh, <br />they have other locations to store cars that are picked up after the close of business at the <br />Pleasanton storage facility. <br /> <br />In response to Chairman McGuirk, Mr. Obra explained they recondition the cars through <br />local businesses and remarket them to retail sellers.
